Israël: Provider gedagvaard wegens gebreken mobiele telefoon.

Toelichting:

Een toonaangevende exploitant van mobiele telefonie in Israël werd gedagvaard omdat een type mobieltje op de markt was gebracht die functionele gebreken vertoonden. De exploitant had die gebreken moeten onderkennen en kenbaar moeten maken en de mobieltjes uit de markt moeten halen en de kopers het geld koopbedrag moeten terug betalen of vervangende mobieltjes moeten aanbieden. De tegen het bedrijf ingediende collectieve claim bedraagt 13,8 miljoen euro welke is vervat in de collectieve klacht welke via dagvaarding aan de exploitant is betekend. De vraag is of het tot een rechtszaak komt of dat er een schikking komt.

Naar Nederlands recht kan deze zaak worden vergeleken met “waarvoor is betaald is niet geleverd” weshalve vergoeding of ontbinding van de koopovereenkomst kan worden gevorderd..

( BW)(PARTNER-COMMUNICATIONS) Partner Communications Announces it Received a Lawsuit Requesting Certification as a Class Action

ROSH HA'AYIN, Israel--(BUSINESS WIRE)--Jan 22, 2009--Partner Communications Company Ltd. (''Partner'' or ''the Company'') (Nasdaq:PTNR)(TASE:PTNR), a leading Israeli mobile communications operator, announced that it was served on January 20, 2009 with a lawsuit requesting certification as a class action, filed against Partner in the District Court of Tel- Aviv-Jaffa. The claim alleges that Partner misled its customers who purchased a particular model of handset (the ''Concerned Customers'') by not highlighting the fact that there were faults with certain of that model's functions and not offering replacement models free of additional obligation.

If the lawsuit is certified as a class action, the total amount claimed from Partner is estimated by the Plaintiff to be approximately NIS 70 million. Also, the Plaintiff seeks a declaration to require the Company to attach to the particular model of handset a notice describing its limitations and to credit the Plaintiff and the Concerned Customers for handset payments made or alternatively to replace the handsets with a different model free of additional obligation.

Partner is reviewing and assessing the lawsuit and at this preliminary stage is unable to evaluate the probability of success of the lawsuit or the range of potential exposure, if any, with any degree of certainty.
